1.      Acceptance of Terms
These Terms of Service govern your use of the Badger Mods website and any purchases you make from us. By accessing our site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

3.      Eligibility
You must be at least the age of majority in your jurisdiction to purchase from our site, or have permission from a parent or legal guardian.

4.      Products, Builds, and Customization
Badger Mods sells watches, watch modifications, parts, and accessories.

Many of our watches are custom built or made to order based on the configuration you select. Because of this, custom, made-to-order, personalized, or special-request builds are generally final sale, except in cases of confirmed defects or quality issues.

We make every effort to display products accurately, but colors, finishes, and appearance may vary due to lighting, photography, and device screens.

5.      Orders and Acceptance
When you place an order, you are making an offer to purchase. We reserve the right to accept, reject, or cancel any order at our discretion, including for suspected fraud, incorrect pricing, stock issues, or verification needs.

If an order is cancelled after payment has been processed, a refund will be issued to the original payment method.

6.      Pricing, Taxes, and Errors
Prices are shown in the currency displayed at checkout and may change at any time.

If an error occurs in pricing, product description, or availability, we reserve the right to correct the error and cancel the order or contact you with available options before fulfillment.

You are responsible for any applicable sales taxes charged at checkout.

7.      Payment
We accept payment methods made available at checkout. By submitting payment information, you represent that you are authorized to use the payment method and that the information provided is accurate and complete.

8.      Shipping and Delivery
Shipping destinations, rates, and processing times are outlined in our Shipping Policy, which is incorporated into these Terms by reference.

Estimated processing and delivery times are estimates only and are not guaranteed. Delays may occur due to carrier issues, weather, peak shipping periods, or other events outside our control.

Risk of loss passes to you upon delivery of the package to the carrier, but we will work with customers in good faith to assist with delivery issues when possible.

9.      Returns and Refunds
Our Return and Refund Policy is incorporated into these Terms by reference. If there is a conflict between these Terms and the Return and Refund Policy, the Return and Refund Policy controls for returns and refunds.

10.  Gift Cards
Gift cards are non-refundable and cannot be redeemed for cash, except where required by law. Gift cards may not be replaced if lost or stolen unless required by law.

11.  Intellectual Property
All content on this site, including logos, images, designs, text, product photography, and branding, is owned by Badger Mods or our licensors and is protected by intellectual property laws.

You may not use, reproduce, distribute, or exploit any site content without prior written permission.

12.  Reviews and User Content
If you submit reviews, photos, or other content, you grant Badger Mods a non-exclusive, royalty-free license to use, display, and share that content for marketing and store operations, unless you request otherwise in writing.

You agree not to submit content that is unlawful, abusive, defamatory, misleading, or that infringes the rights of others.

13.  Prohibited Uses
You agree not to:

·         misuse the site or attempt unauthorized access

·         interfere with site security or functionality

·         use the site for fraudulent or illegal activity

·         copy, scrape, or reproduce site content for commercial use without permission

14.  Disclaimers
To the fullest extent permitted by law, the site and products are provided “as is” and “as available.” We do not guarantee uninterrupted access to the site or that it will be error-free.

Nothing in these Terms limits consumer rights that cannot be waived under applicable law.

15.  Limitation of Liability
To the fullest extent permitted by law, Badger Mods will not be liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruption.

Where permitted, our total liability for any claim relating to a product or order is limited to the amount paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations, so these limits may not apply to you.

16.  Indemnification
You agree to indemnify and hold Badger Mods harmless from claims, damages, losses, and expenses arising from your misuse of the site, violation of these Terms, or infringement of another party’s rights.

17.  Governing Law
These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict of law principles.

18.  Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on the site. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.
